01Parties
These terms are the agreement between Fanda (Hong Kong) Industry Limited ("we") and the company that signs up to use seacomb ("you"). The person who signs up on behalf of a company warrants that they are authorized to accept these terms for it.
02What seacomb provides
Tools such as Lead Source (finding leads in public social comments), Account Hub (managing your own social accounts), Touchdown (clip editing and distribution scheduling) and Inquiry Hub (receiving inquiries from WhatsApp, Facebook Pages and Instagram). Which tools are enabled depends on your account; features evolve over time.
03Accounts and teams
- Managers manage members and permissions; members see only what is assigned to them;
- Keep your password to yourself;
- If you find someone else using your account, email leo.sunfl@gmail.com immediately.
04Your obligations
- Platform rules: Meta's (WhatsApp Business Policy and Commerce Policy, Facebook and Instagram terms), TikTok, YouTube and the others;
- Only reply to people who contacted you; obtain the recipient's consent before starting a conversation with a template; no spam, no prohibited content;
- Fetched public comments may only be used for your own legitimate business contact, in compliance with local law (including personal-data protection law);
- Do not use seacomb for anything illegal, attack the system, resell accounts or impersonate others.
If you violate these terms, we may suspend or close your account and cooperate with the platforms concerned.
05Third-party services we rely on
- Connecting numbers and exchanging messages goes through Meta's official interfaces and is subject to Meta's terms;
- Meta charges template-message fees to your own Meta account; we do not handle them;
- AI uses the provider you choose and your own key; fees and rules are that provider's;
- If these services stop or change their rules, related features may be affected; we will tell you as soon as we can.
06Who owns the data
The data you enter, fetch and receive is yours. We process it only as described in the Privacy Policy; you can export it at any time; when you stop using seacomb, it is deleted as described in Data Deletion.
07Fees
Fees are as set out in the order or written agreement between you and us.
08Availability
We do our best to keep the service stable but do not guarantee it will never be interrupted. Maintenance and upgrades are announced in advance where possible; changes to platform interfaces may temporarily affect some features, which we will fix as quickly as we can.
09Intellectual property
seacomb's software, design and text belong to us; your data belongs to you.
10Liability
To the extent permitted by law, we are not liable for indirect losses (such as lost business). Our liability for direct losses is limited to the fees you actually paid us in the 12 months before the loss occurred.
11Suspension and termination
You may stop using seacomb at any time; if you violate these terms, we may close your account. After closure, data is handled as described in Data Deletion.
12Changes to these terms
The date of the latest update appears at the top of this page. For significant changes we will notify you in advance; continuing to use seacomb afterwards means you accept the new terms.
13Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are first resolved by negotiation; failing that, by the competent courts of the Hong Kong Special Administrative Region.
